Terms of Service and Client Agreement

Please review the following prior to booking your session.

Session Fee & Deposit

A non-refundable session fee is due at the time of booking to reserve your session date and time. This deposit is final and secures your appointment. The remaining balance must be paid on or before the session date. By booking, you acknowledge that no refunds will be issued under any circumstances, and chargebacks are strictly prohibited. Any attempt to dispute payment through your financial institution will result in legal action to recover the full session fee and additional costs incurred by Goldenlight Creative.

Late Arrivals

Clients arriving late will have their session time reduced accordingly. This may result in fewer proofs and edited images. If shooting on location and the Client is more than 15 minutes late, the session will be canceled, and the session fee will be forfeited.

Cancellations

Clients may reschedule a session due to illness or emergency with at least 24 hours notice without penalty. Failure to provide such notice or cancellation of the shoot will result in forfeiture of the session fee. The Photographer reserves the right to reschedule due to unforeseen circumstances, such as illness, weather, or equipment malfunction.

Archive Responsibility

All images will be available for download four (4) weeks after the photo reveal. Upon download, the Client is responsible for archiving and protecting all digital photographs. Goldenlight Creative does not permanently archive purchased or unpurchased image files. Clients must back up their digital files and copy them to new media. Goldenlight Creative is not liable for loss or damage to digital files after delivery.

Refunds and Changes to Orders

Your luxury artwork is a custom order. Due to the digital nature of the product, we do not offer refunds, cancellations, or changes after the reveal appointment. All sales are final at the end of your call and photos are sent to our retouching and production departments, respectively. Retouching typically takes two (2) weeks, though it may extend up to four (4) weeks.

For wall art, photo albums, or prints arriving damaged, you may submit a claim for either a replacement or studio credit. Claims must be submitted to info@goldenlightcreative.com within 72 hours of receiving your print items.

Payment Disputes

By booking a session, the Client agrees that all payments are final and non-refundable. The Client is prohibited from initiating chargebacks with their credit card company or financial institution. Any chargeback attempt will result in legal action, with the Client responsible for all legal fees, chargeback fees, and any additional costs incurred by Goldenlight Creative.

Reshoots

Re-shoots are at the sole discretion of the Photographer and will not be granted due to poor wardrobe choices, makeup, hair, weather issues, or failure to follow the Photographerโ€™s guidance.

Failure to Perform

In the event the Photographer cannot perform due to unforeseen circumstances (e.g., fire, act of God, illness, etc.), both parties will attempt to reschedule. If rescheduling is not possible, the session fee will be returned and the Photographer will have no further liability. This also applies to lost or damaged photographic materials without fault on the part of the Photographer.

Capture, Delivery, Post Production, and Editing

The Photographer is not obligated to deliver every image or video captured during the session. The selection of images and footage is at the sole discretion of the Photographer, who retains creative control over the final post-production and editing styles. Custom retouching is not included but is available at an hourly rate of $120/hour.

Model Release

Client grants Goldenlight Creative permission to use images, video, and sound captured during the session for promotional purposes, including advertising, websites, portfolios, and social media, without compensation. Goldenlight Creative will not sell images to third parties without the Client’s consent.

Copyright and License

Goldenlight Creative retains all copyrights to the images, video, and sound created during the session. The Client is granted an exclusive license to reproduce and display purchased images or video for personal use. The images may not be sold, licensed, or used for commercial purposes without written permission from Goldenlight Creative.

Indemnification

The Client agrees to hold Goldenlight Creative and its representatives harmless for any injuries sustained during the session. The Client is responsible for the safety of themselves, their children, and their guests, and releases the Photographer from any related claims.

Non-Disparagement

The Client agrees not to make any disparaging, negative, or defamatory comments regarding Goldenlight Creative, its owners, employees, or services. Any breach of this clause may result in legal action for damages.

Force Majeure

Neither party will be liable for failure to fulfill its obligations under this Agreement due to events beyond its control, including but not limited to acts of God, war, government restrictions, or pandemics. If such events occur, both parties will make reasonable efforts to reschedule the session.

Severability

If any provision of this Agreement is found unenforceable, it will be severed, and the remaining provisions will remain in effect.

Jurisdiction and Venue

This Agreement is governed by the laws of the State of Texas. Any disputes arising under this Agreement will be handled exclusively in the courts of Collin County, Texas.

Attorney Fees

If legal action is necessary to enforce this Agreement, the prevailing party shall recover attorneyโ€™s fees, costs, and other legal expenses.

Client Satisfaction and Disputes

In the event of dissatisfaction, the Client agrees to notify Goldenlight Creative within 72 hours of the session or receipt of final products. Both parties agree to make reasonable efforts to resolve disputes amicably before resorting to legal action.

By proceeding with your booking and payment, you acknowledge that you have read, understood, and accepted the terms outlined above.
